By accessing, downloading, registering for, or using Dario (the “App” or “Service”), you agree to be bound by these Terms of Use and any policies referenced here, including any applicable privacy notices. If you do not agree, you must not use the Service.
You acknowledge that these Terms form a legally binding agreement between you and the provider of Dario. Your continued use of the App after any update to these Terms constitutes your acceptance of the revised version.
To the maximum extent permitted by law, Dario and its affiliates, officers, employees, contractors, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, loss of goodwill, or business interruption, arising out of or related to your use of or inability to use the Service.
Because the App is provided for personal organizing assistance and not as a professional advisory service, you assume full responsibility for decisions you make based on the App’s content, recommendations, or outputs.
Dario may offer virtual coins or similar in-app currency that are purchased through Apple’s in-app purchase system. Any such coins are consumable items, have no cash value, are not legal tender, and may not be exchanged, transferred, or redeemed for money or any other monetary equivalent.
All purchases are final to the extent permitted by applicable law and Apple’s policies. If refunds are available, they are handled in accordance with Apple’s rules and applicable law, not by the App unless required otherwise. The Service may require coins to continue saving certain batch records or to access optional features, and balances are maintained locally or as otherwise described in the App.
We may revise these Terms at any time by posting an updated version within the App or through another reasonable notice method. We are not required to give individual notice each time a change is made.
When updates become effective, your continued use of the Service means you accept the revised Terms. If you do not agree to a change, you should stop using the App.
You agree to indemnify, defend, and hold harmless Dario and its affiliates, licensors, and service providers from and against any claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys’ fees, arising from or relating to your use of the Service, your violation of these Terms, your infringement or alleged infringement of any third-party rights, or any content or information you provide.
This obligation applies whether the claim is brought by a third party, a government authority, or another user, to the extent allowed by law.
Dario grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service solely for your own lawful, non-commercial personal organizing purposes, subject to these Terms and applicable law.
You may not use the App in any manner outside the scope of this license, and no ownership rights are transferred to you. All rights not expressly granted remain reserved by the provider and its licensors.
The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be accurate, reliable, secure, error-free, or uninterrupted, or that any defects will be corrected.
Dario is a lightweight personal organizing tool designed for clothing, bag, and makeup decluttering. The App allows users to create batches of item photos, record usage frequency and optional notes for each item, and receive editable Keep, Maybe, or Let Go suggestions based on local rules rather than image recognition. It is intended as a private decision-support and recordkeeping tool, not as an e-commerce guide, resale platform, valuation service, appearance rating product, or cosmetics efficacy analyzer.
The Service may let you import 2 to 12 photos per batch from your camera or photo library, assign weekly, monthly, rarely, or never usage labels, add notes, and review a generated summary. Results can be adjusted by you, stored locally as batch history, and reflected in a Keep List. The App also includes a coin balance system and optional in-app coin purchases to support continued saving of organizing batches.
The Service includes the following major areas: Login, Home, Batch Input, Result, Keep List, History, Settings, Coin Store, Feedback, and Agreement pages. Certain features depend on local storage, device permissions, or Apple in-app purchase availability.
Current functionality and behavior:
The App currently uses local rule-based logic to generate suggestions. For example, notes containing certain words may influence a recommendation, and usage frequency is used as a core signal. The App does not claim to perform real visual recognition, medical analysis, body evaluation, beauty scoring, resale pricing, or product safety testing.
Batch records may be stored locally, including item metadata, suggestions, reasons, history entries, and keep-list data. Deleting a batch removes the local record, but does not necessarily remove any source photos from your device’s camera roll or other system storage unless the App expressly says otherwise.
We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, used the Service in a harmful or unlawful way, or created risk for us, other users, or the integrity of the App.
You may stop using the Service at any time. Termination of access does not automatically entitle you to any refund or compensation, except as required by applicable law or Apple policy.
You must be at least 17 years old, or the age of majority in your jurisdiction if higher, and have the legal capacity to enter into a binding agreement to use Dario. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.
By using the App, you also confirm that your use is permitted by the laws of your location.
You retain ownership of any photos, notes, feedback text, or other content you upload, import, enter, or submit through the Service (“User Content”). We do not claim ownership of your User Content.
To operate the App, you grant us a limited, non-exclusive, revocable, worldwide, royalty-free license to process, store, reproduce, display, and transmit your User Content solely as necessary to provide, maintain, improve, and secure the Service, including generating organizing suggestions and saving local records. This license is limited to the functionality of Dario and does not permit us to use your User Content for unrelated purposes unless separately disclosed and authorized.
Any recommendations, summaries, reasons, labels, or other outputs generated by the App are automated and provided for informational and organizational purposes only. They are not professional advice and should not be treated as authoritative, complete, or guaranteed to be correct.
You are solely responsible for reviewing and deciding whether to follow, modify, or ignore any generated result. Your reliance on any output is at your own risk.
You agree not to use the Service to engage in unlawful, fraudulent, deceptive, abusive, harassing, defamatory, obscene, or otherwise harmful conduct. You must not upload content that infringes another person’s rights or that violates any applicable law or regulation.
You also agree not to: reverse engineer, decompile, disassemble, or attempt to derive source code from the App except where such restriction is prohibited by law; use bots, scrapers, automation, or similar tools to access the Service; interfere with security or access controls; attempt to bypass purchase flows or usage limits; introduce malware or malicious code; or misuse the Service in any way that could damage the App, devices, or users.
The Service may not be used to create or distribute harmful content, impersonate others, or exploit device permissions for purposes unrelated to the intended personal organizing features.
The App, including its software, design, trademarks, logos, interface elements, text, graphics, and other materials, is owned by or licensed to the provider and is protected by intellectual property laws. Except for the limited license granted to you under these Terms, no rights are transferred to you.
You may not copy, modify, distribute, sell, rent, lease, publicly display, or create derivative works from any part of the Service unless expressly permitted in writing or required by law. Any feedback or suggestions you provide may be used by us without obligation to you, to the extent permitted by law.
You are responsible for the accuracy, legality, and appropriateness of the content and information you provide to the Service, including photos, notes, frequency selections, and feedback. You must ensure that you have all necessary rights and permissions to submit any material you upload or enter.
You are also responsible for safeguarding your device, account access, and any local data you choose to store. If you share your device with others, you are responsible for preventing unauthorized access to your records and purchases.
The Service is provided “as available.” We do not guarantee that the App will always be available, uninterrupted, timely, secure, or free from defects. Features may depend on device capabilities, operating system behavior, Apple services, local storage, or other third-party components outside our control.
We may modify, suspend, limit, or discontinue any part of the Service at any time, including features, content, coin offerings, or support channels, without liability to the extent permitted by law.
These Terms shall be governed by and interpreted in accordance with the applicable laws of the jurisdiction in which the Service provider is established, without regard to conflict-of-law principles, unless mandatory consumer protection laws in your location require otherwise.
Any dispute arising from or relating to the Service shall be resolved under the applicable laws and procedures required by law.
